So my friend got abused from her mom and she wants to leave her house. She turns 18 in 6 months. Can she go to the courthouse and file for abuse and have my mom as her gaudaian??

And how do you know this? We don't even know where the OP and her friend are. Laws vary.


To the OP,
Like I mentioned, laws vary from state to state. And the court will want to see proof of the abuse. Your mother needs to be on board with this and willing to go to court. If she's that close to turning 18 though, unless the court will grant an emergency order, court proceedings can take so long it might not even be worth it.

And where is your friends father in all of this?

She can call children and family services and report the abuse, after an investigation, they will determine if it is true and what is best for the child. Perhaps parenting classes or parenting supervision, or perhaps being removed from the home.

If the child is removed, your parents can apply to be a foster parent or a temp guardian. There will have to be home inspections and court approval

My friends dad lives there but the family is having issues with him too.

Has your friend called the police? Talked to a school counselor? Called cps? Taken pictures of any marks left by the abuse?

But frankly, let her wait the 6 months and then leave. Its unlikely that any court action or investigation will be completed in under 6 months.
