My name is not on my son's birth certificate. I have full custody after an abuse case against his mother went to court. I had to have paternity testing to gain custody. He is in school now and has to use mother's maiden name. I want my name on his birth certificate and I want him to have my last name.

No big deal. This would be handled at your local court. You'll pay a small court cost and show that you have both paternity and custody... it should be a simple matter. Give your local Municipal court a call to find out what forms to fill out and how to get it done.

Also to change the child's name your going to have to seek the mothers permission. If she doesn't object then it can be changed but if she does then you may end up with a hyphenated name.
