Hello,

My husband and I are filing joint return. I am studying and not working currently. My tuition fee for 2009 is ~25K. Since my husband's 2009 MAGI is more than the limit set for American Opportunity Credit, Hope credit, or lifetime learning credit, we are not getting any education credit.

I tried adding the tuition fee as itemized deduction (non reimbursed job related education expenses or under Other Miscellaneous Deductions) and that helps to bring down the tax. I would like to know if that is correct to do. We are US resident (having green card) and filing form 1040.

Appreciate any help in this regard.

Tuition fee is deductible only as adjustment of income on line 34 of Form 1040. You must do form 8913 and must have 1098-T from school. Maximum deduction is $4000 if you meet the requirements.
