View Full Version : Mom trying to evict daughters boyfriend in Wisconsin

Hi, I live with my mother in a house that my grandfather owns. Recently my boyfreind had surgery and needed time and help recovering. My mother and I invited him to stay with us for the approximate 6wk recovery period. Now my mother is telling him he has to leave or she will call the cops. He still has about two and a half weeks till he can return to work. I would like for him to stay. My boyfriend has done nothing illegal and has been paying for his own food (and mine), loundry detergant and other misc exp. Can she legally evict him? Please help. Thank you

He's considered a tenant in terms of the law. So, your mom CAN evict him, but she needs to go through the steps your state requires. We have a copy of your states landlord/tenant law on a sticky at the top of the real estate page. Look there to see what the procedures are.

Yes. Technically your grandfather would have to take your BF to court for eviction.

In my view, the above makes your mother the landlord. If a roommate rents a room to another person, the roommate is the new tenants landlord even though he's renting himself. This is the same idea.
