Hello,
Could you please tell me if I can still file 8843 for 2004?

My situation is as follows: I've been studying in the US since January 2005 but I first arrived in the US with my visa on Dec. 27th, 2004. I filed as a non resident for 2005, 2006, 2007, 2008. However, I just realized that I never sent the form 8843 for 2004 (I was only in the country with my F1 visa for 4 days and had no income). This year, I'll be filing as a resident since 2004, 2005, 2006, 2007 and 2008 count as 5 full calendar years.
Now I'm worried that me not filing 8843 for 2004 might be a problem.

As far as I know it would not be any problem. Also I have heard that IRS can only look at last 3 years taxes not before that, so If u haven't had any problems till now.

Disclaimer: I am not an expert so this advice is just based on what I have heard .

Thank you for the reply! I guess I'm just wondering if it wouldn't be better to just send the 8843 for 2004 so that my NR file is closed and complete. I heard it was best to do so, particularly in regard to immigration regulations.
I've accounted for the days spent in the US in 2004 on all my subsequent 8843 forms in 2005, 2006, 2008, and 2009.

Get the 2004 version of the form, complete it, sign it and mail.

Better late than never!
