Ok. Army SGT currently in Iraq. I married a non us citizen last September and she has never been to the U.S. or earned any U.S. income. We have a child who has a U.S. SSN. I have been recognized by the military as been married with child and have obtained monies from the Army accordingly. Both wife and child are currently staying overseas. How should I file my taxes?? Any knowledgeable help would be great!

Interesting case. For sure, you can file jointly with your wife. Her physical location is irrelevant.

You MAY be able to claim the child as well, because he/she may be considered to be a U.S. resident due to your military status.

When and where was the child born?

Thank you for your help! My child was born overseas last year. She is a legal citizen of the USA. She has birth certificate abroad and a U.S SSN. The concern was the fact that my wife has no U.S. SSN and I have been paying attention to a lot of the threads and that seem needed to file over the internet. Seeing my current location it is troublesome to do by mail. And I did not want to miss out on any monies or misfile. I really appreciate your help. Thanks.

Sorry, but to get your wife an ITIN, you MUST mail the return with Form W-7 to the address on the W-7. No way around that requirement.
