View Full Version : DWI & then a minor consumption 3 weeks later

I recently received a DWI three weeks ago eight hours after my last drink (last drink at 2.am. And I was arrested at 10 a.m.). I didn't get pulled over, but questioned upon walking out of a store. The cop smelt alcohol on my buddies breath and breathalyzed us both. My buddy (who is 21) blew a .17 and I blew a .08. Since I had the keys in my pocket I received the DWI. It was a dumb situation and I was planning on contesting the charge. However, just three nights ago I received a minor consumption for having one beer at an old high school buddy's house. I know I'm stupid for drinking before my trial, however I thought I was being smart about it, because I didn't drink while the party was going on, but after most everyone had left and there were only 8 or so of us hanging out, listening to music and playing cards. I had the one beer and 5 minutes after it the cops showed up. I blew a .03 and received a minor consumption citation. My question is how screwed am I being I was already awaiting trial for a DWI and in the mean time got a minor consumption? Will I be facing possible jail time? Or just a few years of supervised probation? I live in Southern Minnesota, in the most conservative county in the state (this is no joke, type in Fairmont, Mn on Wikipedia and you'll see that our newspaper 'The Sentinel' is rated the most conservative paper in all of Mn) so I highly doubt I'll receive any leniency for my wrongdoings.

Also, wanted to clarify the statement I made about it being a dumb situation. I take full responsibility for driving and accept I made a mistake, however I never would have drove in the first place if I felt I'd blow a .08 or if I felt I'd being putting others at risk. I seriously didn't feel drunk, but just merely hungover, tired, and hungry. I'm still holding my belief that a .08 eight hours after my last drink wouldn't be the same level impairment if say you consumed 3 beers and blew a .08. Secondly, I didn't get pulled over and questioned for my driving, but because the car has a faulty part (front right door won't latch) and a 'vigilante' called that in. Lastly, the night of my minor I had a sober ride.

If you blew a DWI/DUI the results of the test are all that matters.

I am an accident investigator - I've had (literally) thousands of people tell me they didn't feel drunk, just hungover, tired, hungry or something else.

I would hire the best Attorney I could find.

Thanks for the advice. I'm being completely honest when I say I didn't feel drunk. I lost an uncle to drunk driving and have also had an acquaintance of mine become paralyzed because she hopped in a car with a drunk driver. So its definitely something I'm not for or wouldn't do. Now that I realize you can blow a .08 the morning after drinking, I realize there are thousands upon thousands of people each weekend morning driving drunk.
