View Full Version : What can I do to get my property and money back

I lived with a man 11 years I thought he was my best until about 3 years ago. I am on social security disability for the past 4 years . I got $28,000 back pay from SSA and spent all of it on moving us to a larger apt. and all new furnishings paying off all my bills and credit cards and down payment on a new car.I also paid off all his bills for him. Last year all my money was gone and I just get my monthly check. He got his SS retirement right about that time and also works fll time. I noticed things started turning up missing and it was never anything of his after awhile Iknew it was him.Then things started happing to my new car and he let all the coolent out and dicconted the hot light and I over heated so bad I needed a new engine I could not aford a new one and still make the payments so it got repoed. After that we were not getting along so he said he was moving so that meant I would have to move to cause so he found a place 3 days later and left me flat. I found a 2 bedroom mobile home I could aford alone. He was just renting a room and he did something and the lady kiked him out after 2 1/2 months so he asked if he could stay with me for awhile and I let him.He brought all his things and never put anything in his storage like he said he would. After 3 months I started finding things missing again so I told him look for another place. He found a place and moved out and took everything but my furnture. I never called the police cause he said he didn't take it but he started replacing my tools and was giving me money its been 1 1/2 months and now he said he can't give me anymore. He owes me about $6,000 WHAT CAN I DO ? I can't replace it I'm 62 and very bad health and alone no family. Sorry about my spelling

Unfortunately, there is little that you can do in this situation. I've had something similar happen to me, not quite to the extremes that you went through though. IF you had contacted the police when these events occurred you MAY have been able to get your stuff back, however without receipts or serial numbers they most likely would have just told you there was nothing they could do.

Was he on a lease with you at any time? You MAY be able to recover something if he was. If he was on a lease you can take him to small claims court for rent, however I doubt this was the case.

Honestly, after the first time this happened you should have known better and not let him stay with you anymore, but I somewhat understand.

Did you pay his bills via check? If so you MAY have a case for small claims court for that money as well. Granted you have no contract for repayment I'm guessing, so that may be a tough sell in court.

My advice would be to speak to a lawyer and go from there.

The legal advice is to take him to Small Claims Court - it will be your word against his and the Judge will decide which story is most feasible.

If he argues "gifts" you argue that he was repaying you.

Again, it's your word against his.
