View Full Version : Where and how do I file for abandonment

Hello I am trying to file for abandonment My ex-girlfriend and I have a son that is now 4 years old. She left when he was 3 months old. I have never moved and never made any attempt to stop her from seeing him. She was arrested for drug trafficking. I would like to move because I have a better job offer in another state. But I was told that I can not leave the state without his documents. My current wife has been a part of his life and we both want her to eventually adopt him. But I don't know how or where to begin. Lawyers are expensive and I don't have any Information as to where she is or a number or anything. Can anyone help me.

What documents are you referring to? Unless there is a court order that gives the mother visitation and your moving would impact that visitation schedule, then there should be no legal bar to your moving.
If there is such a schedule, then you need to go to court to petition that the schedule be changed. If you can show the mother has not been following the schedule, then you should have no problem.

Also abandoment is a state specific law, and this does npt apply to any. In some it would only be leaving the child in a store or side of a road and driving off, In others the term is used for failure to pay child support and not visiting the child.
( but the second is not normally grounds to take away any rights in those states that do have these laws)
You will need to try and get her to sign his rights away, assuming she is on the birth ciertificate or has gained legal status in court.

The father is the one posting. He needs the mother to sign over her rights.
I assume, by papers, you mean his birth certificate. Is your name one it? If so, then you should be able to contact the records department of the county he was born in and request a new one. Once you have that, you can go to the social security office and get a new ss card.
