View Full Version : Need to know what happens if a settlement on a family court motion is not abided by

If a motion goes to case conference and settlement is agreed upon and
Must be fulfilled by a certain date. This was signed by the judge and all
Parties. What if this does not happen? I know then that the motion is quashed and it goes back to the original agreement. Is there anything I can file in case this happens? Also, is he allowed to file another motion
For the same thing when he never fulfilled the first one.

The basics of it would be to file contampt against the other party. Then its up to the situation for the judge to decide. Lets say for example selling a home in today's economy may not go as fast as it used to. So there may be no penalties if the house has been and remains on the market. So it depends on what the situation is as to what's going to happen.
