View Full Version : Can an ex-con get custody?

I had a son about 3 months ago and the father says he's going to fight me for custody. He is not on the birth certificate and was not there for the birth to sign any papers, because he was in prison. He has been to prison three times now for grand theft auto, assault with a deadly weapon, drugs and a violations of parole. I am a young mom with another son. I am on state assistance and currently looking for a job, but not having any luck. I buy all my kids items and things they need, but I do live with my mom. What are the chances he would get any type of custody? Or does anyone think there is anything that he can tell against me? I am just curious if anyone has any opinions about this.

Yes he can get custody of some kind as a starting point. Im sure his track record isn't new information to you. Since you did choose to have a baby with him then in all likelihood he will get some form of custody. It might start supervised but if he keeps up with it then it can move to something different.

If you go to your state assistance facility and go through them for child support if you let them know its not in the child's best interest to be around its father they can help you in insuring that the father is not granted custody.
