I am trying to change my sons last name and I'm not sure if I need his fathers permission he hasn't been here since he was born and the baby is 5months old.. Does anyone know if I can change it with out him ?

Check with the clerk's office that manages birth certificates. But most likely you can't.
However, a person can use any name they want to as long as the name isn't being used to commit fraud. For examplke, if you want to register him in school as Johnny Jones instead of Johnny Smith, you can do that. The school will need a copy of the birth certificate, but they should have no problem listing him as Johnny Jones.

Changing his birth certificate requires petititoning a court for a legal change. I doubt if the courts will allow it without the father's permission. But, again, you can use any name you want on medical cards, for school etc. as long as there is no intent to defraud.
