In a word, NO. However, you're going to need to explain exactly what's happening, what state you live in, and whether you have a lease.

It's my guess, given the limited information you provided, that you are only a month to month tenant, and that you're not being evicted - your tenancy is simply ending.

I am a month to month tenant and have faithfully paid the rent on time for the past 15 months.I live on a second floor where the only access to my apt is a landing which has been in bad shape for some time.now the landlord says that I have to move so they can fix the landing with no option to return.Yet the landlord has stated that they want to move in to my apt. after the repair to the landing is completed.I have no complaints against me and yet she tells me this the day after she collected my last months rent.she has not served me any papers as of yet and I guess she is just waiting for the first of the month to collect another months rent.The landing condition has been like it is now for months until the city of san diego ordered her to get it fixed last month,"so SHE claims", and yet I have seen no documents to that effect nor any contractors come out to access the problem.

The only thing that's important, is that you are a month to month tenant. They can give you notice to move for ANY reason whatsoever, or no reason at all.

To do it properly, she has to serve you with WRITTEN notice before your present rental period ends. That'll most likely be before the 1st, and you'll have a month to leave.

But, even if she doesn't do it right, and I help you to fight for a month or two, you're still going to have to move. That's the bottom line.

As excon said, you are a month to month tenant which means EITHER of you can end the tenancy with just one month's notice. Doesn't matter how faithfully you paid or that there are no complaints.
