View Full Version : Will I get probation violated for new charge and how long jail time?

I'm on felony probation for attempted possession of marijuana w intent to sale in a school zone... the kind of probation I'm on is where if you screw up the deals off and I can do the rest of time in jail... been good for 9 months... got 9 more to go... but I got caught with a straw w cocaine residue in it and he charged me w simple possession of cocaine and drug paraphernalia... my pos pretty cool but wondering what will happen when I go to court and should I tell my po... please help

Yes, you need to tell your PO. If you don't, that's a violation all by itself.

Just because your PO is "pretty cool" does not mean that the Judge will be so "cool" with you. A straw with cocaine residue will more than likely put you back to square one and you'll be doing all your time in the slam, and not just the remaining 9 months either. You're looking at your original sentence here. Better get a copy of your Final Disposition paperwork and review this as this is the same paperwork your Judge will be looking at when you come before him again at your VOP hearing. Better tell the PO immediately or as Exie said that's another violation in itself - not reporting any police contact.

Let me see, the probation you are on, can send you back if you screw up and you screwed up.

1. you need to worry about the charges on the current arrest.

But it is possible you need to go talk to PO right away
