I live in Georgia and I would like to know if I can sue my ex-spouse who, while we were separated and I was living out of the house, filed an insurance claim for something that happened at the house. She receieved two checks from the insurance company and signed my name on them and her name and then cashed them. I filed a claim in small claims court. Is that viable?

I cannot answer this question, however, in May of 2009, My spouse and I received a overpayment from the escrow account in both of our names. Since my spouse was overseas I was given permission to signed the check and deposit it into the bank account. Nine months later while going through the discovery process for divorce, stbx is now claiming forgery. We have been to court twice whereas stbx was found guilty in contempt of court. Is this about the money or retaliation, the bank has withdrew the money from my account. Any great ideas?

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

Do you have any proof that you received permission to deposit the check? Why has the bank removed the money? Are they citing pending litigation? What ideas are you looking for?

Was the money put into a joint account, how was the money used, was it used to pay household bills that were also under his name. When you signed "his name" did you sign your name under it showing you signed for him
