View Full Version : Can I get a homestead after they put a lien on the home

I have two rentals and another home I live in. The rentals are not worth what I owe. Can creditor card companies put a lien on the rentals and or the home I live in. If I homestead the one I live in, can they still put a lien on it. I don't really care if they put a lien on the two rentals. I am on Social Security. No other income. This is California and I have two credit defaults totaling over $50,000.

They can put a lien on any assets you have, but many states have "homestead" laws that will exempt all or part of your primary residence.

The question comes down to whether, in California, one must do an official "declaration of homestead", or whatever, in order to perfect ones homestead right.
