View Full Version : Renting with a foreclosure

I'm actually going through a situation like this and need a little more clarification. I live in amarillo, Texas and was renting a single family house. My landlord went through a lawsuit and I haven't been able to get get a hold of him since July. I think he may have gone to jail and his grandson was actually the one I signed the lease with and made payments to in their office, which is now closed. I haven't paid rent since may and my lease was up in October. Just last week I was finally contacted by a different agency letting me know the property was in foreclosure and would be finalized in about a month in which I should be receiving a notice from the sheriff. What are my rights considering I haven't paid rent but haven't been able to contact anyone to pay rent to?

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

If you find you can't pay rent because you can't find who to pay rent to, then you should have been putting the rental into a separate savings account, so you would have it if and when it came due. Since your lease has expired AND the property is in foreclosure, then you should be looking for a new place to live. You will have 90 days from the date the foreclosure is finalized, but you don't need to wait. Move as soon as you find a place. I would then wait 1-2 years leaving the money you didn't pay in the separate account. After that period, if no one has tried to collect, you can then recover that money.

Agreed, merely being in foreclosure does not mean you don't owe the owner of the property the rent, And the rent should be gong each month into a bank account so you can pay anytime you are ordered to do so.

But you will be moving, so find a place
