View Full Version : Lousiana property inheritance laws

My Mother and stepfather lived in Louisiana. My Mother recently died and my stepfather died about 30 years ago. My Mother had three children, all adults by a previous marriage, all living and two children from their marriage, both adults. Both of these children from their marriage has died. One of thes children had a son, adult now. Their was no will found in her possessions or recorded at the courthouse. Who inherits this home and land?

The rules in LA for a case where a person dies intestate without a surviving spouse but with liiving descendants are that the property is split amont the children (or their descendants if the children do not survive). In this case it seems that the property is split four ways - between the three surviving children and the one grandchild who was parented by the fourth child (who is now deceased). The fifih child, also deceased, had no descendants and so does not affect the split of property. See: Wills and Testaments (http://www.retirementandestateplanning.com/law/chapter_4.htm)

In the state of louisana is a succession the same thing as a will? Can it be used as a will if there was no will?

What do you mean by "a succession?" Please clarify.

It's 12 heirs can one are to heirs give away stuff in the home.

The article that ebaines linked to suggests that a "succession" is Louisiana's term for a probate estate.

My mother and father no longer living they have 12 kids can two of the kids take personal stuff out the house and give it away with talking to the other kids.I need to know what right I have for the people to put it back into the home.

Please start a new thread rather than using someone else's thread.

You mean to ask can they "give it away without talking to the other kids... "? No. Apply to be appointed personal representative and then get the court to order them to get it back for the estate.
