View Full Version : Extradition To Virginia From California

Two weeks ago my husband was arrested in California for a bench warrant out of Virginia for violating probation because his restitution was not paid off on a felony forgery case. His original sentence was 3 years with 21 years suspended sentence for writing 3 bad checks. The total amount due is $5,079. Now that he was arrested California said that they were lifting the no bail and that if Virginia picked him up it was up to them but they were taking it off the court calender for anymore court hearings now that he waived extradtion. So my question is what is the likelihood Virginia will come all of 3,000 miles for a VOP for $5,000 and if so will he most likely be sentenced to or can they just get his probation reinstated and get him on a payment plan. Any input will be greatly appreciated.

This is all up to the Judge at the time of his VOP hearing. They may just come and get him. Who knows? Also if he absconded from the state of Virginia, the Judge may decide to just put him in prison for so many years versus give him any more probation.

It is almost 100 percnet, when he was orgainally stopped, they held him that first 30 min to 2 hours while they checked with Virginia to see if they wanted to come get him. At that time someone made the choice to do it. They could have course chage it, but seldom do once they actually put them in jail and book them.
Also if they are going to get him from that distant, it can be almost assumed 100 percent that the DA or PO is going to go after a longer term prison sentence
