View Full Version : What could happen with a level four drug charge in Kansas?

My boyfriend is being charge with a level four drug charge of marijuana because of his juvt record, He is 19, in his juvy he has 3 charges of weed and he now just got his first as a adult. We live in KS. What woulds happen? Can he be put on probation or will he have to do hard time? Can they really use his juvy against him as an adult?

It's hard to say what will happen to him. It's a shame, because the state has decided to act criminally toward your boyfriend.

Was he charged as a adult or minor when he was under 18, many sstates on some charges try minors as adults on some crimes.
The prior charges should have little to do with his conviction, and if he knows he is going to be convicteed, and his attorney sees no way to win, work out a plea deal for the best you can get.
What was the current crime, possession only and if so how much, or was it with intent to sell ?

He was charged as a minor, he did 2 week in juvy on third charge in juvy and probation, got early release because he was clean for 9 months, they say they are using his juvy and we only had a dime(5gr) and seeds and stems in ashtray, rolling papers and pipe. No it was not intent to sell.

Hmmph! A few grams of schwag and some stems... Like I said before,THEY are the ones who are perpetrating a crime - NOT your boyfriend.
I cannot imagine that they would sentence him to jail or prison even if he has a juvenile record... But, it IS Kansas, after all.

What do you mean it is Ks? Are you hinting that they can do that?

I'm certain, that Kansas has laws on its books where it says that possession of ANY amount of pot is punishable by a term of imprisonment. That doesn't mean they WILL do it, but they can. Kansas is NOT a pot friendly state.
If it were Seattle, where I live, he wouldn't have even been arrested.
I should have mentioned that he should hire a good lawyer, if he can.

Most likely yes he will just get probation bu it is hard to say what a court will do.
