I missed my filing to the superior court date by two days due to depression to file after losing my two appeals and they said know I can't do anything, have been unemployed since 8-27-09.

I missed my filing to superior court by two days due to health and deppression after losing my two appeals and now legal aid and unemployment of the state of Atlanta says it is too late, after certifying since 8-27-09. I have been under Doctors care and depressed and live alone and not in the best frame of mind. What can I do?

Unemployment filing with superior court. Two days past filing date, due to health with doctors notes, they say that's it, what can I do?

First, please do not keep starting new threads. You need to give us time to answer. If you want to add more info, either edit your post or post a response to the original thread.

Sounds like you have exhausted your appeals. I don't know if there is anything more you can do.

Can I still get another superior court date about my unemployment file if I missed the date to file by three days. I missed it because of a mental breakdown because of job loss on 8-27-09. I lost the two appeals, but the employer was police escorted out of the place I was working, and was not paying state taxes etc. The appeal board knew a lot of these things and still denied me. I went to legal aid and they said because I missed file date, they could not help me. I was so upset and not working that I missed the date by three days. Is there anything I can do, I certified each week over the phone for 7 months. HELP!

Technically you were not able to claim the weeks that you were mentally incapable of looking for or holding work and by filing the claim that you where able to look for work would disqualify you for those weeks. I am not too sure that you would be given another date for an appeal seeing that you did not keep the other appeal date as you were mentally incapacitated.

You can file and try, I doubt it will be accepted. Which taxes were they not paying, / if they were not paying into the unemployment taxes, then you may not be able to collect.

Have you considered sueing the employer directly

I guess I was unclear, I have been looking for work, and did go through both appeals. I just missed the final date to file with the superior court by three days because I was trying to get help with electric bills, mortgage, etc. I was so upset and distracted and being treated by doctors for depression and back pain caused by employer that the date slipped up on me. Surely with proof something can be done to get a new date.

I filed and lost both appeals because I had to quit. The new owner was just payind the previous owner own a finance to buy. She was late 6 to 7 months behine on her rent, and she was not paying state taxes on sales tax. I could not get products I needed because the woman was broke and paying no one. I could not work like that and I helped her and someone lift a heavy shelve and hurt back and had to leave store and go to doctor and put a sign on door. She did not like that and does not even live in the same town. I worked alone as a manager and did everything. I had to quit, because her nonsense.

IF this was your first appeal, maybe. But, since it's going to be your third, I'll bet not. Your original claim was denied. You already went through a couple of appeals with them. Then you had a trial which you lost. You lost two more appeals, and now you missed a deadline for filing your third...

Nope... You don't stand a chance.
