Hi,
I am on H-1B in California (bay area) and my wife studies at a community college as an F-1 student. I am her sponsor and as such, I end up paying a handsome amount of tuition fee every month.
My wife only worked for some part of the year on-campus at a modest hourly rate.
I would like to know if it is possible to claim some refund on the taxes for her tuition fee. We would be filing our taxes jointly.

Thanks in anticipation.

File joint return as residents. Claim tuition and fee deduction based on 1098-T.
Once you file joint return as residents, your spouse must start paying FICA taxes on her income.

OK, so should I ask her college for the form 1098-T ?
I looked up the website: ACS :: 1098T (http://www.1098t.com) but could not find it for her records.
Also, how do you suggest we should file our taxes:
Jointly or Separately?
I guess filing jointly might have more standard deduction (not sure) and filing separately helps her avoid paying the FICA taxes.

Thanks Again

File jointly if you have not already done so.

If you could not get a Form 1098-T, just claim what you did pay in tuition and fees to the community, minus any scholarship money she may have gotten.
