View Full Version : CT law about mother leaving state with child of unmarried parents

My boyfriend & I live in CT, we do not live together. We just found out that the mother of his 2 yr old son wants to move to FL. He moved out on the baby's mother over a year ago. They do have a verbal custody agreement which for the most part is working. He has recently filed for a legal custody arrangement to be set, however a court date has not been set. She does not know the papers have been filed yet as she is for lack of better words some what of a nut case.

Is this legal in CT for her to move to another state without his permission? Especially since paper have been filed?

When is she planning on moving? I don't know that it will be illegal for her to move, as currently there is no order prohibiting her from leaving the state with the child.

Has your boyfriend been established as the legal father of the child, either by a)taking a court-ordered DNA test or b)signing a paternity acknowledgment?

If she moves then he changes the order for custody to one that is called ex parte motion. And get it in front of the judge in an expidited fashion. He can request custody at that time and the ex girlfriend can either return to the state or return the child. Otherwise she will be guilty of kidnapping.
