My daughter and dad were involved in a fender bender(she hit the woman's tire while backing up) today we went to court and he lost because he offered to buy the woman a tire. Magistrate said verbal agreement. The kicker is the woman sued him and he wasn't driving he was the passenger. She was awarded 2800.00 for a flat tire and other previous problems she had on her vehicle. My dad is 83 yrs old and on social security, he don't have this money. Can they touch his social security or do anything with his bank account when the only money he has going into it is his social security? He is worried sick. What happens if he don't pay this woman and what is the minimum in nc that he can pay her monthly if anyone knows.

Whose car was your daughter driving, and why didn't the car owner's insurance cover the damage?

Why was your father sued? Was it his car? As Ebaines said, why did insurance refuse to pay?

What proof did the woman have of the damages she claimed?

And there is no schedule for X dollars a week/month. If he does not pay the other party can take any means legal in your State to collect.

Yes, why did they not notify insurance, but you report this to the insurance,
** who may have problems if not reported to them previously.

The insurance should have had an attorney to represent you.

And why did he get sued, did he own the car?

But they may freeze the bank accounts till you prove that is the only money going into the account
