My son and his girlfriend are deeply in love, but she is under constant threat at her home from her mother and step father. She just turned 15 and wants to be here where she feels comfortable and safe within our home. My son and [her] are not sexually active, he is 17 (almost 18). She is verbally abused by her parents day after day when she gets home from school for meaningless reasons, she has seen a psychologist and been diagnosed with major depression and was told to get medicated for it but her mother refused to get her the treatment she needed. She has been physically abused in the past but it is very rare. Once every month if that she might get a slap over the face or hit on the body somewhere. She has been having suicidal thoughts and has been harming herself physically.

What form of legal assistance can we seek to get some form of temporary custody until a final trial is in order? Something that doesn't allow her parents to take her from my home or pick her up during school hours and take her home against her will. She continuously runs away from home and comes here where she is safe. She agreed herself that she would rather be here with us.

(this form of documentation or court order needs to take place in roughly 2 weeks of time as she can be here on school holidays where her parents can't get her, but they will get her when she returns to school)

She is still a minor, however, and although you would like to help and she has divulged this information to you; she is still in her parent's house and all allegations have to substantiated. It won't be easy for you to assist her with this, but there is help and this website may help you.

Thank you, I have been told by my ex husband that she is able to get an AVO out on her parents. Correct? He is a senior cunstable for the NSW police so I trust his judgment well.
She has physical proof of abuse. Can I use this?

This is going to sound harsh but its not likely your going to get custody of the girl since you have decsribed your circumstances. It looks like her only way out is going to be going through the state and maybe foster care. And the state can evaluate the situation and make its orders from there.
