My husband wants to adopt my child he is 7 years old he has been around since he was a baby, his biological father has never been in his life seen him like 2 or 3 times running into him and never did nothing for him, he doesn't pay child support and is not on the birth certificate my question is does he still have to sign over rights even if he isn't on the birth certificate and how would I go about doing that? Does he have to take a dna test before he signs over his rights? And by the way I live in Michigan

Yes, he will still have to sign over his rights.

If he was never proven the father and if there is no custody orders or child support orders, yes you will have to start with the DNA test which would be requested when you did your court filing

Being on or not being on birth certificate does not change his requireemnt to sign off for the adoption.

Next if you never went to court to get a child support order, he is not behind on a penny, since none was ever ordered

What happened with me...

My daughters biological father isn't in the picture, and I talked to a lawyer, and he told me.. yes there has to be a DNA test before anything can happen, it will be a court orderd DNA test.. but if the biological father doesn't show up than they just take that as him admiting paternity.. once that happends, you will probably have another court date making him start paying child support, then you will need to talk with a lawyer because that is the only way you can do an adoption unless you know what paperwork has to be filed and signed and all of that stuff.. and the court won't tell you what papers, trust me I tried.

All in all, the whole prosses should take about three months to a year
