My parents currently have power of attorney over my nephew, he has been living with him his whole life he is currently 19 months, my sister and her boyfriend lived with my parents also but got kicked out because they were stealing and using drugs. The boyfriend or the father of the child has not had any contact with the kid since December and my sister goes over intermittently to visit the child my parents allow her to visit so they do not have issues but now both are asking for more rights to the child and will not sign kinship forms for the child they are both still drug addicted and stealing my sister has arrest warrants and lord only knows with the boyfriend what avenues can my parents take to get custody of the child?

They don't have Power of Attorney but I'm not sure what they DO have - guardianship, perhaps?

They need to go to Court and prove the parents to be unfit. As long as guardianship has been awarded it should be a relatively easy process.

My concern is your parents asking for more rights - what other rights do they want/need? There is always a possibiity that a request for formal custody will be countered with a petition (by either parent) for full custody - that's a risk a person always takes.

More info would help - it sound sounds like a very bad situation with you and your parents "saving" this child from a very uncertain future.
