I have a 2yr old, her father and I never married. When my daughter was born her fathers "mother" said I have to put fathers last name for my child. We were never married. Long story short... his family wanted all rights to the child and the father had no interest he refuse to sign the birth certificate. His mother wanted to take my child from me. I want to add my last name to my daughters name... how does this work, is it my name then the fathers or can my last name follow his last name , I know I have to address the courts just not sure how the names should follow.

If he is legally recognized as the father,you will need his permission. Another way is to prove that it is in the child's best interest to have his/her last name changed.
It should be easy to add your last name as a child's second name.
