My son died from "Sudden Unexplained Death Syndrome". He was 32 years old, he has a 2 yr old son. He was living with his girlfriend who said "no" when he asked her to marry him. Actually he asked her to marry him several times and she never did marry him. My son had an extensive collection of glass art and a large collection of crystals, and silver and crystal jewelry. He had these collections for years before he even met her. After he died, his girlfriend took all his valuable art collection and crystal collection and jewelry collection to her mother's house. I went to her mother's house and asked her to give me his collections. She refused, so I had to threaten her with a law suit. She reluctantly gave me a few of his crystals, 3 belt buckles, and one necklace. I have pictures of my son's collections, so I know she kept most of his things. I asked her for specific items and she pretended to be dumb and said she did not know what I am talking about. I sent her pictures of the items, but now she is saying that all that my son owned is now hers to keep. I don't mind her keeping a few of his things, but I feel that what was my son's is now mine, since he died suddenly and without a Will.
Also, she has been partying non-stop since my son died. She is a drug addict and just called me a half hour ago, high as a kite. I could hear it in her voice. She told me she went to Chicago last night for a concert, she said, because she knew my son would have wanted her to go... She also said that she wanted to get together with me so that I could give her back the things I took that belonged to my son, and decide what she wanted to let my son's brother and sister and me keep as mementos of my son's life. I guess she thinks she was his wife?? Anyway, I don't know what I'm legally entitled to, though I feel that since she did not marry him and he owned these things before he met her that she is not entitled to anything unless I say she is.
She continued to use drugs during her pregnancy with my grandson and gave birth to a very sick, drug addicted baby. She did not help pay a penny towards my son's funeral. While she was in drug rehab, I paid all her bills, including her child support obligations, insurance, and all other expenses she had.
Should I call my lawyer in the morning?
