View Full Version : Child support legal age NY State

My child is 22 years old and is in his last term of University. I have just petitioned to have him taken off child support with the hearing on March 15th since in NY children are not automatically taken off child support. Do I need to do anything special for this hearing or is this procedure automatic? What should I do to prepare for speaking to the judge?

Please pay more attention to posting guidelines. There is a Read First sticky in the Divorce forum (where this was moved from) that directs questions of a legal nature to this forum.

The max age of child support in NYS is 21. However, its possible your divorce decree may have extended it until he finishes school. If not, I would find the statute that states support ends at 21 and just refer to that statute in your petition and request to the judge.

Also bring a copy of the birth certificate with you if you have one.
