View Full Version : I paid support in Feb, but can't in March. Is that abandonment?

I am a father who has caught up with my arrears of almost $10,000. I did not pay December, but paid January and February's child support, but cannot in March. I will pay in April; however, I am being threatened by the mother of my child that she will file an abandonment warrant. Can she? Is so, does this hold an merit?

Abandonment is leaving children unattended - she can take you back to Court for failure to pay support but she cannot get an "abandonment warrant."
You have not abandoned your children. You also cannot skip months - if you skip March and then pay in April, that is your March payment.

Some states refer to failure to support your children as abandonment. But it would take a lot more than a missing a month to qualify. On the other hand, if you find you can't afford your payments you should file for a modification of the support order. Also, if you can make at least a partial payment you should.
But the next time she threatens an abandonment warrant , tell she's welcome to try, but any court will reject it. And, if they didn't, ask her how she expects you to earn money to pay support if you are in jail.
