View Full Version : Question about tax return for a J-1 visa holder married to a you.S. Citizen

I am a U.S. citizen and I married a J-1 work visa holder last year. My earnings were about $27,500 in the state of Texas for the year 2009. Now, the issue with my husband's visa is that he was on F-1 visa until June 2009 and on J-1 from then onwards. His earnings were about 1,700 in Texas when he was on F-1 visa and about $24,000 on J-1 in Pennsylvania. Now, I need some advice on whether we need to file a joined federal tax return or separate individual tax return? Which one will be beneficial? Also, since I've been unemployed since June 2009, can my husband file me as dependent? Or can I file him as dependent because he was unemployed for the first half of the year?

Now, about the state of Pennsylvania, what forms does my husband need to file? Are there any city taxes that need to be filed in this state?

I know it is a bit complicated. But, we're clueless and do not want to spend a lot on paying agents. Any professional help is appreciated

You can only file as married filing jointly or married filing separately.

You husband can file joint return. Other options depends upon when he entered the U.S. and purpose of J-1 visa?

He entered U.S. two years ago on F-1 and then his employer hired him on J-1. He'll be here for about five more years.

Yes, he can also file joint return as residents or as married filing separately.
