View Full Version : How could I apply to get refund of my NJ state tax for year 2008?

Hi,

About me:
I am an Indian resident and I was working in HSBC New Jersey office from Sept 2008 to March 2009.

Tax Filing for 2008:
I filed my NJ State tax return using NJ Web File for year 2008. Filing was successful and I received confirmation number also. In late Novemeber 2009 I noticed that I didn't received my NJ Tax refund so I checked with Call center. The Executive told me that they didn't received my W2 form and had sent me notice regarding that.

Problem:
As I am in India, I didn't came across any such notice. I called my LanLord if he received any such notice(where I stayed when I was in NJ). He confirmed and sent me the scanned copy of notice in Jan2010.


1. Please let me know how should i respond to this notice now?
2. How can i get my NJ State tax refund?
3. I have recieved W2 for 2009 also. Should i file my 2009 state tax before resolving the issue for 2008?


Notice:
Dear Taxpayer(s):
An examination of the Division's records indicates that our letter of April 21, 2009 has not been answered.
This letter requested the following additional information:
Acopy ofyour2008W-2 and/or 1099-Rstatement(s)
Since you have failed to provide the requested information, your request for refund/additional refund is denied.
The above determination shall be final unless you apply to the Director of the Division of Taxation for a hearing within ninety (90) days. If you disagree with our findings and would like to apply for a hearing, please read and follow the enclosed Tax Appeal Process.

1. File your 2009 tax return.
2. About the notice, 90 days have already passed. I am not sure if you will get the refund or not.
Still file a reply and attach the required forms. Attach a statement as to why you missed the 90 days period.
