View Full Version : About the tax deduction for the rent paid in 2009 - working in US on EAD

I'm working in US pending my green card status, currently, I have EAD (Employment Arthorization Document) from the INS, Also, I don't have the work visa, I'm completely depended on this EAD to work and stay in US.
My question is, I can detect the rent paid in 2009 as tax deductable, please let me know if you need more information to answer my question. My tax consultant says, it should be able to put the rent I paid in 2009 as tax deductable since I'm in US working on EAD.

EAD does not change your tax return. Rent is not deductible unless it is for your business.
What visa do you have? When did you enter the U.S.

Originally, I was working on H1B work visa, but it expired 5 years ago, I entered US in Mar 2000 on H1 visa. Since 2005 I'm on the EAD (this is not a work visa) pending green card status(permanent resident). So from the tax point of view, the sole purpose of my stay in US is work related, tha question is , does this qualify my situation to deduct the rent paid until I get my green card.

No, you can not deduct the rent.
