View Full Version : Can the father of my child stop me from leaving the state?

I live in Iowa and I have a 5 month old son. The father of my child has left us and refused to see our son. Yet he wants to stop me from moving out of the state with my child. Can he do this?

If he shares legal custody of the child he may be able to refuse to consent to your relocation and bar you from taking the child out of state, but you can challenge his refusal, particularly if he's not taking a role in the child's life. You need to see an attorney for solid advise on your state and circumstances. Most attorneys will meet with you once for free.

If he has visitation and/or if he has partial custody, he can object.
You can petition the court to allow you to move, using the fact that he does not vist. It will be up to the court
