How hard would it be for me to change my children's last name? My ex gave up his parental rights in April of 2005, in North Carolina. We now live in Texas & have now for five years.
My husband now wants to adopt them & for them to take his last name. What paperwork do I need to get this done?

You would contact the father and get the adoption approved. In the adoption papers you can request a name change. I don't believe he lost all rights unless there is more to this story.

There is A lot more to this story. I still have a no conctact order in place for the father. He nor his family is to have NO conctact with the children until NC judge states otherwise. That was back in 2004.
The grandmother just passed & I conctacted NC to see if the kids could go & see her when see got sick & they said under NO conditions do ANY of the family see them.
The father has to complete a lot of things in the court order before he can EVER see his kids, which he has not attempted to do as of this date.
I still have the court order & the order where he gave up all rights to the children. Is this what I need to do the name change?
