My 17 year old son was driver a friends car and was in a car accident. My son does not have a drivers license. I am collecting social security disability payments. Can this money be garnished in a lawsuit?

Why is he driving with no license? Whose fault is that?

No, your SSD money cannot be garnished but you could lose any of your assets in a judgment situation.

The friend that let him drive the car is also at fault... maybe try and discuss it with his friends family

Depends on the company - the owner might very well be personally responsible.

I'm a liability investigator in NY. I am seeing more and more companies disallowing claims for reasons just like this.
