View Full Version : Received order of court, but I wasn't served.

State: MD. I (defendant) received in yesterdays mail a order of circuit court granting plaintiffs "motoin to seal or otherwise limit inspection" for the entire divorce case. (case has been over/closed for awhile). The only problem: I was never served with the underlying motionrequesting the sealing. (as an FYI, I was pro se for the case). I disagree with the sealing, and need to know what steps I need to take to challenge this. Do I appeal? File a notice to vacate the judgement? Both? Any assistance is appreciated. Thnak you

Why don't you want it sealed ?

You file a motion requesting the formal motion be set aside because of improper service.

Thank you, FR_Chuck. Should I/Do I need to file an appeal at the same time as well, or should I simply focus on filing a Motion to Vacate/Set aside? And to answer the prior poster, I'd prefer not to get into ALL of the specifics here, but there is a definite reason I wish for the case to remain in it's public/non-sealed state. One reason being: If I've been accused by the ex of DV 5 times, and not only have all 5 DV cases been dismissed/thrown out, but my Sanctions Motion relating to those 5 cases was awarded? I think there is benefit for the public to have the records surrounding all of that to remain open. I see no harm to anyone by having these records remain public.
