View Full Version : Can a school a student has been withdrawn form change that students IEP

Our 11 year old son was removed from his school because they felt as though they could not meet his needs and maintain the safety of staff and other students. He does have severe behavior issues that are linked to being with his mother. We are putting him in another school that is not only not in the same district, but no even in the same county. 9 days after he was kicked out, the school sent an amendment of his IEP which they expect the other school to follow. We have found he has been mis- diagnosed and we know he has Aspergers. Can a school that has withdrawn a student do a re-evaluation and change the IEP or should that be done at the new school the child will be attending in another district?

Yes they can. I would suggest a meeting with all the team members at the new school asap. That would include You, the school Principal, your son's home room teacher, special ed teacher, and other aids or assistants or teachers that will be involved with your child, including the school counselor.
