View Full Version : What are the consequences of leaving my husband and taking my children in nj

I plan on leaving my husband and taking my 2 children 16 & 12 with me. I will not tell him ahead of time because of his temper. In the past/present there is physical and verbal abuse, but, I never called the police, therefore I do not have any proof of the incidents through the years. We've been married for 16 years. My plan is to move into an apartment (we own a house) in town so that the kids can continue going to the same school. Would it be in my best interest to go to Court and get temperary custody of the kids before I actually move out? I reside in NJ -

Since there are no police reports I am assuming that you never went to a domestic violence shelter? The reason I ask is that I've dealt with moms and kids who have gone into a shelter to get away from the abuser and can only speak to that experience.

No, I have never been to a domestic violence shelter. It would be his word against mine reg the physical/verbal abuse. Always wondered how do you prove verbal abuse??
