I got married in February of 2006. My son was born in June of 2005. The biological father is not in the picture and I would like to know how my husband can adopt my son. We have been looking into him adopting my son since we got married and we haven't been able to find out any information. The biological father is not mentioned on the birth certificate and has had no contact with my son. Please help me.

You hire an attorney, the birth father is contacted and asked to sign his rights away, It does mot matter that he is not listed on the birth certificate and it does not matter that he has had no contract.

He still has legal rights that he can go to court and inforce.

So after he signs his rights away, your new husband can adopt.

If he will not sign his rights away, you will have to aruge in court that he has not visited, he has not paid any child support and so on.

Do a perternity test has to be taken before signing over rights

It depends - is there a father on the birth certificate? Is there an order for child support? There is no blanket answer.
