View Full Version : Am I resident or Nonresident Alien?

Hi,

I am living in United states since Aug. 2005. My Visa is F1 (Student Visa), and I am doing my PhD here. I am wondering whether I am resident alien or not? I bought a condo in 2009, Am I eligible for Obama's tax credit? I have all requirement, but I am not sure whether I am resident alien or not. I have heard about green card test of 183 days test, however, I believe they are not valid tests for F1 visa. Please let me know what you think about it

For 2009 you are nonresident. In 2010 you will be resident. You do not get homebuyer credit.
On F1 you are exempt from residency for 5-years. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843. Your income is not subject to FICA taxes but you must pay federal and state income taxes.
