I meet all the requirements to fill in the 540NR-Short form apart from one. I only have a 1042-s, not a W-2 or 1099s. My understanding is that the 1042-s is basically a W-2 for foreigners. Therefore can I use it to do the short form, or do I have to file the long? I ask because at first pass the short form gives more of a refund... not sure why!

To anyone who finds this in a search. I eventually got through to the Franchise Tax board and they told me that a 1042-s can be used when filing a 540NR Short form. Hope this helps
