View Full Version : Tenant pays oil heat but lets tank run out, how can I get them to have oil

My tenant has their own furnace and tank. They are to pay for own oil. They keep letting oil tank run dry. The are told what is in tank and it is time to order oil. This is damaging to the furnace. And service has to be called to restart. How do other landlords handle "tenant pays for heat"?

I had a clause that they were liable for damage caused if the oil tank ran out - it happened once. They had to pay to have the lines cleaned.

It never happened again.

How is the lease written?

I have just the opposite situation. I am the tenant and yes we are responsible for filling our oil which we have no problem with. What I do have a problem with is our landlord is responsible for letting us know when we are low on oil(as we don't have access to the basement) so we can refill the tank but they the landlord don't always tell us and just recently it ran out and we wanted him to pay for the diesel we had to add so it can make it the next few days so oil can be delivered since we found out the hard way that we had no more oil. Do I have a leg to stand on or am I SOL?
