I work in NY and live in PA. Last year I received a gas lease payment for my land in PA. It seems that NY uses a percentage of Federal to determine tax liability to NY. The gas lease adds income to my Federal. The net affect of the additional Federal Income makes it so NY now gets about $450 more tax from me. Is there any way categorize the gas lease income in such a way that NY does not get to tax it?

The NY non-resident tax form does require you to report all income, but this is so that the appropriate tax bracket can be determined. Then that tax bracket is applied only to your NY source income. So this gas lease in PA should not affect the amount you owe NY state except to the extent that it might put you in a higher tax bracket. Are you sure you are properly categorizing your NY source income versus non-NY income on the non-resident return?
