My 18 yr old granddaughter has a 4 month old baby, she is not married to the faher of the baby but the baby has the father's name. My question is does the father have as much rights to the baby as the Mother does with them not being married? No legal binds except for the father's name on the birth certificate.

Jean, I'm 99% sure the mother has all the legal rights.

To the best of my knowledge, unless he goes to court to assert his rights, or is taken to court for child support, he has none under the law.
Just curious, do you not want him around the child? Or are you hoping he'll be legally obligated to be in the child's life?

Not that we don't want the father around the child. They are livng together for now which may be ending very soon and it seems the father and his parents are trying to get my granddaughter to leave without the baby. They are saying this baby will not be around HER parents again! No reason for that they are just jealous and the parents are blaming my GD for everything going wrong. She is a high school senior and a ball player working on getting a ball schlorship to a college in the same town as the maternal grandparents live. A lot on her plate the father baby sits , has NO job. No long range plans and my GD is trying to become a nurse (long range) .
Father locked my GD out last week for not cleaning up the kitchen he messed up! She called her mother to come get her and the maternal mother went out with two deputies to get her daughter and the baby. Tha is why the paternal parents are mad! I think the maternal mother did the right thing by taking the deputies with her. No way would I go without a deputy! They are trying to punish my
Granddaughter for doing that saying it was all her fault. Anything this young man does seems to be OK with his parents. We are trying desperately to get our girl and her baby out of that mess but she keeps going back!

Okay, I'm not sure where those other people are getting their information because he absolutely has just as much right to the baby. He is the father he is on the birth certificate already so he does not have to go to court for the DNA test to prove he is the father that has already been established. Now, if your granddaughter does not want him to be able to come by and pick up his child when ever he wants then she will need to go to court to establish legal custody. She absolutely has to go to court for this.
