View Full Version : Can my sister's insurance be responsible if I drove her car without insurance

I drove my sister's car thinking my own insurance covered this. Unfortunately I didn't realise I wasn't covered due to my being the named driver. Now I am being charged for driving without insurance and the other person and his passenger are going to claim against me for damages to car and whiplash. I have been told by my insurance company that under the Traffic Act that my sister's insurance company has to deal with the claim. Is this correct

Your sister's insurance will cover her car. If her policy pays out its maximum for injuries, then they could possibly sue you for residual damages. Your insurance company will play no part in this incident.

Thank you so much for responding to my question.
My sister has told me that each insurance company work differently and hers may not be liable!!
My sister's insurance representative is arranging to come out to see both myself and sister to advise accordingly.
Fingers, toes and eyes crossed!!

Your sister told you right because her company does have the right to deny the claim if you were the driver. They may want to delve into why you were driving her car before making a decision.
