View Full Version : I went to pretrial hearing on credit card suit and plaintiff came with no proof

I am being sued for credit card debt that is past the sol in Colorado by a junk debt buyer and today I had a pretrial conference where the plaintiff came empty handed, the judge set up a new pretrial hearing 30 days from now , what would be my next step?

File a Motion to Compel Documents and get a Hearing scheduled prior to the pretrial. The judge will have to rule on this and make the plaintiff produce the documents. The judge will order the plaintiff to produce the documents within 30 days per court order. Once no documents are produced you can file a Motion to Dismiss after the 30 days comes and goes.
The pretrial hearing can be reset to a later date so don't worry about that.
