Hi Everyone-- I have a question regarding my DUI probation. I've fulfilled all my court-ordered requirements, faithfully attend AA meetings, etc. I'll be moving to another state soon, and my roommate has alcohol in the house (probation stipulates no using or possessing). I don't drink now, yet I know that the probation gives any officer the right to search my person or dwelling without a warrant. Is it likely that officers make routine random stops at dwellings like this for searches? Currently, I'm fulfilling my probation successfully through a neighboring state, and I'm very much left alone (I send them verification of my weekly attendance at AA meetings every few months, but that's it). My roommate and I are both responsible adults who would not bring attention to ourselves otherwise. Just wondering; any feedback is appreciated.

Hello phoenix:

I've been on probation a few times, and I've never been searched. It's my belief that they would only search if they had cause.

However, YOU are not permitted to have alcohol in your home. IF I'm wrong (and I've been wrong before) and they find booze, they'll violate you.

My wife owned a gun. She wasn't on probation. They didn't care. They told me to have her get rid of the gun, or live someplace else.

Make your roommate a present of a liqour cabinet with a key lock and give him all copies of the key.
