I was just wondering if they can extend my probation if I'm all paid up on my fines and probation costs but I was caught for absolute sobriety twice but never got a new charge in the whole time I've been on. I was sentenced to 18 months probation and am suppose to be off next month. Is there any way that they can extend my supervison if I didn't receive any new charges and am all paid up?

No, they can't extend your probation time if you are not in front of a judge at a VOP hearing.

violation of probation, if you broke the rules, they can violate you and take you before the judge, who may put you in jail ( even though you were not charged with a crime, if you broke the rules of probation.

Thanks it was only my 2cd violation in 17 months and no new charges so u think that I could still get off next month

Only the 2nd? Often they may put you in jail on the first, often for the second.

What did the PO ( probation officer) say when you talked to them about the violation.

If they don't have a warrant to pick you up, looks like they are going to let you off

He said that he will talk to his supervisor and she might put me back in counseling and extend my supervison until I'm done with counseling, but I am all paid off on everything, I didn't think they could do that, isn't that like double jeopardy or something?

If the court orders counseling, the court could not close it till the counseling is over, but this is not normal and you would have to appear before the judge.

No, they are not trying you for the same thing, what they are doing is not putting you in jail for the entire probation time, if you had 18 months probation, and they violate you, they can put you in jail for 18 months even if you have one day left on probation.

But most likely he is just messing with you.
